JAMES BURNSIDE

A 22-year-old Laceyville man was sentenced Friday to 7-14 years in state prison for involuntary deviate sexual intercourse with a child sometime between Jan. 1 and Feb. 16.

James Edward Burnside, of Main Street, appeared before Wyoming County President Judge Russell Shurtleff who told him he also has a lifetime registration responsibility as a sexual predator under the Adam Walsh Act.

Asked before the sentence if he had anything he wanted to say, Burnside told the judge, “I’m sorry.”

Court records indicate that Wyoming County Children and Youth Services opened an investigation after a 15-year-old female accused Burnside of groping her breasts over her shirt.

Further investigation by state police alleged that Burnside also victimized two boys under the age of 13.

According to a criminal complaint, Burnside told police that he and the alleged victims were “messing around” and “I knew better.”

He had been in the county jail since Feb. 17, with 178 days credit toward his sentence.

Other sentences handed down in the Wyoming County Court of Common Pleas Wednesday:

*Frederick Michael Allenbaugh, 45, of Tunkhannock, was sentenced to 26 days-6 months in county jail and a $1,000 fine for DUI, second offense, on July 5, 2016.

*Todd Roger Benson, 42, of Nicholson, was sentenced to 30 days house arrest followed by 5 months probation, a $500 fine and $370 restitution for DUI, second offense, on Jan. 27.

*Evan Drew Bolthouse, 19, of Tunkhannock, was sentenced to 12-24 months in state prison and a $500 fine as well as a 15-year registration as a sex offender under the Adam Walsh Act for indecent assault on Oct. 1, 2016.

*Cody Allen Cook, 26, of Nicholson, was sentenced to 6-18 months in county jail and a $500 fine for simple assault on April 2.

*Chelsea Logan Donvito, 21, of Tunkhannock, was sentenced to 12 months probation and a $500 fine for disorderly conduct on Jan. 9, 2016.

*James Corey Gleason, 22, of Tunkhannock, was sentenced to 24-84 months in state prison and a $500 fine for failure to verify address on Jan. 18.

*George Leonard Gurney, 51, of Tunkhannock, was sentenced to 7 days-6 months in county jail and a $500 fine for DUI, second offense, on May 6, 2016; and to 12 months probation, a $500 fine,and $560 restitution for possession of drug paraphernalia on March 3, 2016; and to 28 days-12 months in county jail, a $1,000 fine and $1,139.18 in restitution for DUI, third offense, on July 6, 2016,with sentences to be served consecutively.

*Matthew Alex Karpinski, 39, of Ewing, N.J., was sentenced to 30 days-6 months in county jail, a $1,000 fine, and $3,078.88 in restitution for DUI of a controlled substance on Oct. 21, 2016.

*Ryan Forrest Kernan, 28, of Nicholson, was sentenced to 36 months-120 months, a $1,000 fine and $10 restitution for possession with intent to deliver on Feb. 13, 2013.

*Joseph William Kircher Jr., 26, of Dalton, was sentenced to 6 months probation and a $300 fine for DUI on March 24.

*Vladimar Malinak, 53, of Scranton, was sentenced to 3 days-112 days in county jail and a $300 fine for DUI on June 12, 2016.

*Beau James Marshall, 27, of Meshoppen, was sentenced to 6 months intermediate punishment commencing with 30 days house arrest, and a $1,000 fine for DUI of a controlled substance on Feb. 7, 2016; and to 5 years intermediate punishment commencing with 90 days house arrest and a $1,000 fine for DUI of a controlled substance, second offense, on Dec. 23, 2016, with sentences to be served consecutively.

*Joseph Alan Parkhurst, 32, of Stevensville, was sentenced to 36-72 months in state prison, a $500 fine and $1,376.15 in restitution for robbery on April 27; and to 24-48 months in state prison and a fine of $500 and $1,512 in restitution for criminal attempt to commit robbery on April 28; and to 12-24 months in state prison and a $500 fine for theft by unlawful taking on April 29, with all sentences to be served consecutively.

*Heidi Lynn Pifcho, 42, of Tunkhannock, was sentenced to 12 months probation and a $500 fine for recklessly endangering another person on July 29, 2016.

*Ismael Retamar, 40, of Scranton, was sentenced to 9-36 months in state prison, a $500 fine and $1,827.04 in restitution for retail theft on Sept. 17, 2014; and to 9-36 months in state prison, a $500 fine and $4,130.13 in restitution for retail theft on Aug. 12, 2015, with sentences to be served consecutively.

*Kelvin Maynard Salsman, 56, of Laceyville, was sentenced to 3-6 months in county jail and a $1,000 fine for DUI of a controlled substance on Aug. 25, 2016.

*Frank Harvey Simko, 69, of Wyalusing, was sentenced to 12 months probation and a $500 fine for statement under penalty on June 6, 2016.

*Leo Joel Smith, 42, of Harveys Lake, was sentenced to 16-60 months in state prison, a $500 fine and $4,004.94 in restitution for theft by unlawful taking on Feb. 9, 2011.

*Nicholas Robert Wilson, 35, of Tunkhannock, was sentenced to 16-48 months in state prison and a $500 fine for operating a methamphetamine lab on March 29, 2015; and 6-12 months in state prison and a $500 fine for possession of a controlled substance on Jan. 16, 2015, with sentences to be served consecutively.

*Douglas Richard Woodward Jr., 30, of Wilkes-Barre, was sentenced to 2 months-12 months in county jail and a $500 fine for theft by unlawful taking on Feb. 17.

*Michael Stephen Zimmerman, 29, of Tunkhannock, was sentenced to 6 months intermediate punishment and 30 days house arrest and a $1,000 fine for DUI, second offense, on Dec. 12, 2016.

OTHER CASES ON THE DOCKET

*Darrell R. Andras, 40, of Mehoopany, appeared before Judge Shurtleff where he was to have been sentenced for recklessly endangering another person on Oct. 29, 2016. Andras withdrew a previous guilty plea and his case was moved to the November trial date.

*Emily Marie Dingman, 20, of Scranton, was to have been sentenced for theft from a motor vehicle on April 15. Her sentencing date was moved to Oct. 20.

Bench warrants for the arrest of the following were issued for non-appearance:

*Brent Michael Calhoun, 25, of Factoryville, who was to have been sentenced for identity theft on Feb. 27.

*Stephen Eric Schwartz, 50, of Noxen, who was to have been sentenced for DUI, fourth offense, on Nov. 22, 2016.

*Dennis Wayne Wisniewski II, 35, of Kingsley, who was to have been sentenced for theft by unlawful taking on Aug. 20, 2016.
